These Terms and Conditions govern your use of the VAM Building Inspections website located at www.vambuildinginspections.com.au (the ‘Website’). By accessing or using the Website, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Website.

These Terms and Conditions apply to the Website only. They do not govern the provision of building and pest inspection services, or any repair and maintenance work carried out under the ‘Find It. Fix It.’ service, which are subject to a separate inspection agreement, scope of works and/or quote accepted by you at the time of booking.

1. About Us

VAM Building Inspections (trading name of Victorian Asset Maintenance and Building Inspections) is an independent building and pest inspection business based in Frankston, Victoria, providing pre-purchase building inspections, building and pest inspections, and related repair and maintenance services across Frankston, the Mornington Peninsula and South-East Melbourne.

References to ‘we’, ‘us’ or ‘our’ in these Terms and Conditions refer to VAM Building Inspections. References to ‘you’ or ‘your’ refer to any person accessing or using the Website.

2. Use of the Website

2.1 Permitted Use

You may use the Website for lawful purposes only and in a manner consistent with these Terms and Conditions. You may use the Website to:

  • Learn about our building inspection, pest inspection and repair services
  • View our service areas, general pricing information and FAQs
  • Submit an enquiry or book a building and/or pest inspection
  • Read blog content and educational material about the inspection process

2.2 Prohibited Use

You must not use the Website:

  • In any way that violates any applicable Australian or international law or regulation
  • To transmit unsolicited or unauthorised advertising or promotional material

  • Pricing information and cost guides shown on the Website are indicative only — final pricing depends on the size, age and location of the property, and will be confirmed with you before booking
  • Photographs of inspections, findings and on-site work are representative of our services and individual outcomes will vary from property to property
  • General information about the inspection process, building defects, or repair options is provided for education only and is not a substitute for a formal inspection report or professional advice specific to your property

You should contact us directly, or refer to your formal inspection report, to obtain specific advice relevant to your property.

4. Enquiries and Bookings

Submitting an enquiry or booking request through the Website does not, by itself, create a binding contract between you and VAM Building Inspections. A booking is only confirmed once we have contacted you to confirm the date, scope and fee for the inspection (and, where applicable, any repair work), whether by phone, email or text message.

We will use your enquiry and booking details to contact you regarding your request and to carry out the services you have asked for. Please refer to our Privacy Policy for information on how we handle your personal information.

5. The ‘Find It. Fix It.’ Service

Where a building and/or pest inspection identifies an issue, you may choose to request a separate quote from Daren Louison to carry out repair or maintenance work. This is entirely optional and is never a condition of receiving your inspection report.

Any repair or maintenance work is a separate service, subject to its own written quote and scope of works, and is not governed by these Website Terms and Conditions. Your inspection report will always be provided in full and on its own merits, regardless of whether you choose to proceed with any repair quote.

6. Intellectual Property

6.1 Our Content

All content on the Website, including but not limited to text, photographs, inspection imagery, logos, graphics, icons and the overall design and layout, is owned by or licensed to VAM Building Inspections and is protected by Australian copyright law and other intellectual property laws.

You may view and print content from the Website for your own personal, non-commercial use only. You must not:

  • Copy, reproduce, republish, upload or transmit any Website content without our prior written consent
  • Use our content for any commercial purpose
  • Remove or alter any copyright, trademark or other proprietary notices
  • Use our name, logo, ‘Find It. Fix It.’ branding, or any other VAM Building Inspections branding without our prior written consent

6.2 Your Submissions

If you submit any content to us through the Website, including photos, testimonials or feedback, you grant us a non-exclusive, royalty-free licence to use that content for the purposes of responding to your enquiry and, where you have consented, for promotional or marketing purposes (for example, on our website, Google Business Profile, or social media channels).

8. Google Services

Our Website uses Google Analytics to collect anonymous usage data to help us improve the Website. It also uses Google Maps to display our service area, and may embed a Google Business Profile review widget.

Your use of these Google features is subject to Google’s Terms of Service and Privacy Policy. We encourage you to review Google’s policies at privacy.google.com.

9. Disclaimer of Warranties

To the maximum extent permitted by law, the Website is provided on an ‘as is’ and ‘as available’ basis without any warranties of any kind, either express or implied, including but not limited to:

  • Warranties that the Website will be uninterrupted, error-free or free from viruses or other harmful components
  • Warranties as to the accuracy, completeness or currency of any information on the Website

Nothing in these Terms and Conditions is intended to exclude, restrict or modify any rights you may have under the Australian Consumer Law that cannot be excluded, restricted or modified by agreement.

10. Limitation of Liability

To the maximum extent permitted by law, VAM Building Inspections, Daren Louison and any associated contractors or agents will not be liable for any loss or damage of any kind arising from your use of or reliance on the Website, including but not limited to:

  • Direct, indirect, incidental or consequential loss
  • Loss arising from reliance on general information published on the Website
  • Loss arising from your inability to access or use the Website

Where liability cannot be excluded under the Australian Consumer Law or other applicable legislation, our liability is limited to the maximum extent permitted by law. Nothing in this clause limits any liability arising from an inspection report or repair work carried out under a separate service agreement, which is governed by the terms of that agreement.

11. Inspection and Repair Services — Separate Agreement

These Terms and Conditions govern your use of the Website only. They do not form part of any agreement to provide a building inspection, pest inspection, or repair and maintenance service.

Building and pest inspection services, and any ‘Find It. Fix It.’ repair work, are governed by:

  • The specific quote, scope of works and/or terms of engagement provided to you at the time of booking
  • Applicable Victorian and Commonwealth legislation, including the Australian Consumer Law
  • Any relevant industry standards applicable to residential building inspections in Victoria

Nothing on this Website constitutes a binding offer or agreement to provide inspection or repair services.

12. Photos and Client Content

We may from time to time publish photographs, videos or testimonials from inspections and jobs on the Website or our social media channels (Instagram, Facebook, YouTube and LinkedIn), for educational and promotional purposes. Property addresses and identifying client details are not published without consent. Clients who do not wish to have images from their inspection or job published may advise us in writing at any time.

13. Privacy

Your privacy is important to us. Our collection, use and disclosure of your personal information is governed by our Privacy Policy, which is available on the Website. By using the Website, you consent to the practices described in our Privacy Policy.

14. Website Availability
